Three stage property purchasing guide
First Stage After finding your desired property and agreeing a price with the vendor, as your representative agent we check the title deed document for authenticity before any sale agreement or deposit is paid - approximately around 10% of the property asking price is the normal percentage.
It is possible to buy property or land without the help of a lawyer but if one were to purchase property say in the UK, it would be the normal route to take and we would strongly recommend that you also elect to use legal services in Turkey, the main reason being that the documentation for signature will be in Turkish and your lawyer will be responsible for completion of all the paperwork and ensuring that your interests are fully represented throughout the entire purchasing process.

Do the local searches and obtain the military clearanceIt is practical for a client to grant power of attorney to their acting solicitor which then enables he/she to attend the land registration office (tapu dairesi) and investigate all the legalities involved with the property being sold, this includes checking that the seller of the property is in fact the legal owner and if there are any debts or charges outstanding against the property and that the building complies with the planning regulations etc., One this has been established the land registry will issue a petition request to the regional military authority to obtain a clearance check for you to be able to complete the purchasing transaction. This is a formality and the process is a little sluggish and may take a few months to return.
Third Stage
Pay the vendor and take possession of the propertyIf your legal representative has power of attorney on your behalf, once the military permission has been received, he/she can complete the sale transaction without you being present and this is very convenient sometimes if it is difficult for you to fly out to Turkey at short notice. If possible, prior to completion of the sale transaction, it is recommend you do visit to check the property one last time to ensure everything is in order, or elect to use the services of your estate agent who will check these details on your behalf. Finally, at the very same time that the vendor is signing documentation at land registry for the transfer of the property, the estate agent and your legal representative work together with the bank to organise the balance of monies over.
